BEGINNING JULY 1, 2008, JUVENILES CHARGED WITH MISDEMEANORS REMAIN UNDER JUVENILE COURT JURISDICTION


STATUTES AFFECTED:

IC 31-30-1-2  Juvenile misdemeanor traffic offenders are now under juvenile court jurisdiction. (Previously misdemeanor traffic offenders were excluded from juvenile court jurisdiction except in Lake and Marion Counties)
               The "once waived, always waived" provision was limited to apply to children charged with a felony who had bee previously waived to a court having felony jurisdiction.

IC 31-30-1-4 The list of "direct file" charges or charges filed directly in adult court if the youth is 16 or older, was amended to only apply to felonies.  Specifically, the charges of carrying a handgun without a license and children and firearms violations are now only direct file if they are charged as felony offenses.


IC 31-30-3-2  The discretionary waiver statute, which applies if a youth is at least 14 and is charged with an act that is heinous or aggravated or part of a repetitive pattern of delinquent acts, was limited to youths charged with felonies.
